Inherited property occupied by one coparcener..other coparcener file suit for damages in addition to partition of property

Your query is not coming out very clear. Need to understand the exact case and how you are going about it. Once that is done then a proper legal strategy can be made. All the coparceners have share on the property. It has to devolve accordingly. Thanks

According the 'Hindu Succession Act ' all the Coparcenar has the right on the property. A coparcener cannot deprive the other coparceners of their right of the property. According the Hindu Succession (Amendment) Act, 2005 confers the status of a coparcener on daughter giving equal rights with the son on an ancestral property.
