Clarification regarding the property buying in Chennai

Sir, My relative is going to buy an apartment in chennai worth 24 lac 50 thousand. He already paid a sum of rupees 7,50,000 as from purchaser side. Remaining amount has to come from bank side as he is going for loan. likely to come soon. We already got legal opinion and documents are clear. Ground floor is only slit parking according to building plan. But the builder says he has future plan of building office there measuring 900 sq. feet but it looks like he has plan of building an apartment there. He also says it is legally allowed. what should we do now? He also made construction agreement mentioning that he will hold 5 laks if we cancel the purchase now.

we want to go through entire papers before giving the legal opinion and you should consult before entering such kind of agreements and now the construction agreement is on compulsory registration. First let us go through the documents.

The builder cannot alter the approved building plan unilaterally to serve his own purpose. You may take up the issue with the DCTP and the local corporation. Also, you may file a written complaint with CREDAI.

Please go through the offer letter and the conditions . Builder is legally bound to give specific car parking area and get it approved and he violates take up the matter with the TN real estate regulatory authority and he can be arrested .

Your query is little lengthy not properly worded. Having said that it is clear that you are having problems with your builder. Better to sit with him and thrash all the issues in amicable way. in case he is still adamant then you have no option but to consult a lawyer so as to take him to the court for appropriate remedy. unless until you take the documents to the lawyer he is unlikely to give opinion off hand.
