Christain family, cooperative society flat transfer in case no will

A man, died without making a will. He jointly owned a flat i a cooperative housing society with his wife, his name being first. These are Christians from karnataka. Now he died without making a will. He has his wife, 1 major child and his mother alive. Now how is his share of flat distributed? Is Indian succession act followed throughout India for Christians? As the lawyer mentioned that they do it as per class 1 legal heirs applicable in hindu succession. Also what documents are required? Approx cost and does his mother get anything?

Hello sir. I have perused your query. In your case the Indian Succession Act will be applicable. In cases where a person has died intestate and has left a widow and lineal descendants then the property will be divided between the latter. The widow in such a scenario is entitled to 1/3rd share wuth 2/3rd share going to the descendants. His mother will not be entitled to a share in such a scenario.

as you have inquired here on lawrato about the person who is christian by religion the person died withoutwill and the deseced is having one major child and wife so the things will get decided by the court order.
