Challenging Unregistered will ?
22-Oct-2023 (In Property Law)
We have an unregistered will and it has already been executed 7 years ago without any issue. The will is last will and there are 2 witness. Now will it be easy to challenge it if anyone wants to? Property transferred is self acquired
hello client as you said the will has bèen already executed 7 yeara ago. in this matter you are willing yo challange it. in this matter uou nèes to move to an appelleate court im this case buy before tht we nèed to know how it got executed legally oe illegLly it can be challangws but ww nees full detaila od the case.
If the witnesses or alive it's better you go for Probate And make the legal hairs as the parties if there is no objection from any one of the legal hires then you would easily get probate in your favour it doesn't matter whether there will is a registered on that and registered with its totally mainly depends on the deposit Jeen of the a testing witnesses
