Cancellation of a sale agreement wherein time limit is not mentioned

My father entered into a sale agreement in SEPT'2015 for a land he had purchased.He accepted advance without insisting for a time frame for execution of the agreement.Only verbal assurance of six months time was given by the second party.Since then no further payments have been given. So how can I get this contract cancelled?

As you have already averred in your statement that sale agreement made in the month of Sep, 2015 and no time had been mentioned therein for registry process only verbal assurance for six month had been given to other party. In such a situation you have right to file promulgation of agreement because verbal assurance is also one of the condition of contract and on that basis you can cancel the agreement. The Seller have every right to cancel the contract because agreement doesn't create ownership of land. If you will provide me agreement document then I will assist you better for cancellation of agreement. Limitation period is 3 years for cancellation of contract. The contents of teh sale agreement will be required to be seen for the purposes of cancellation. You can opt to cancel by sending a Strong Legal notice alongwith cheque of the amount in question. Wordings are necessary and essential
