Justia Ask a Lawyer Ask a Lawyer Ask a Lawyer 1Review your question Q: My father has given his house legally to our step-mother.Can we get share of the property and my mother's jewelleries? My mother has passed away 20 years before leaving behind one son and one daughter. My father has married again but my step-mother has no children. 2 years before my father has legally given his house to her. He has also given my dead mother's jewelleries to her. My sister has invested money in building up a shop in the ground floor of the house and also taken license for distributorship of medicine showing that shop with my father's consent. Though she did not start her business in the shop but has given monthly rent for that shop to my father. Can she get the shop legally? Can we get share of the house and also my mother's jewelleries legally either in the presence or absence of our father and step-mother? If yes, then how?
Sir
1. Your step mother is legally married wife of your mother.
2. She have no issue/ children.
3. She is the owner of the property and jewelery.
Now after her death you are the step son and daughter of you mother. You will inherit the property by the operation of the Succession Act.
Taking you as Hindu.
Thanks
