Can Uncle's son claim share in my father's property?

My Father has done will to me and my brother's name of 3 acres land last 20 years back, and according when we go to make land to our name we came to know that my uncle's son has raised an complaint agains land that they also have share in it... Pls confirm how come uncle is having share if will and pani is also coming in the name of my late father...we ignored court notice which Complaint raised by uncle's son... Now again we have to fight agains land, pls confim if everything has documented and will pani is coming to my father name, then how i can fight a case agains my uncle's son complaint... Please

I believe I have replied to this earlier. You need to take copies of the proceedings from Court and study it. Should find some valid reason for not appearing in court, and try to reopen the matter....

Sir,
Whether the subject matter of the WILL is the self acquired property or inherited property of your father. In case if it was the self acquired property then both of you get equal share as per the said WILL.

Here your uncle son cannot get any right over the said property. In case if it was the ancestral property he can claim his portion of the share which is inherited to his share through his father. He cant claim over your property.
