Can step mother register father's property on her name without my NOC

19-Aug-2023 (In Property Law)
I am a hindu My father held a agricultural land in Jharkhand. He got married again after my mother's death and I have a step brother. My father passed away in 2000 and the land has been getting cultivated by a partner farmer. Now, my step mother wants to get the land registered in her name. What kind of rights will I have in this property post registration? Can she directly register her name without my NOC? Will I be dependent on her discretion to get an equal share? I am very worried, as we 3 don't have an average affectionate relationship and she lives with my step brother.

Venerated Questioner,
As per your question I would like to inform you that you have a valid right in your ancestral property and no one can shrink your right pertains thereto as per the Law of India. Your step mother can not register whole property in her name because you have share in the aforesaid property/ land. It is clearly avers in the Hindu Succession Act and Transfer of Property Act that your step mother have some limited share in your ancestral property and if she is going to register the whole property in her name then you can challenge in the Court regarding your right, title and interest over the ancestral land.. If your required more information in this topics then feel free to call me...

See you have not disclosed whethere the property is ancestral property or self acquired property if the property is ancestral property then you all are having equal share and even if the property is self acquired by your father then also you will have equal share and as in now no legal hairs are there to register the land except you brothers therefore there is no questions that your stepmother can register the property without your consent
