Can son have right over mother's property
29-Sep-2023 (In Property Law)
I am 27 Hindu, married and living in Dubai. my deceased grand father's ancestral property came to my grand mother and then divided among her childern through deed which says"deed will be valid after grandmothers death. my mother is bedridden and as a side effect of regular usage of sleeping pills she is mentally not stable in taking decisions. she trusts her mother and brothers more than me and dad. now mom and grand mom want to sell one of the property and deposit the money in bank under mothers and grand mothers name and the nominee will be my uncle which means we don't have any hold over the deposit. My questions are: 1. can i claim for my share? 2. is there any way that i can block my mom from selling the property. 3. can she sell the property without our concern?
This is a riddle than a query. It is unconvincing that the property is ancestral. So also, it begs the question how grandmother came to be the sole owner of the deceased grandfather. What is the deed executed by the grandmother!
From the information that could be understood, the grandmother has the absolute right to dispose of the property if it vests with her. No one can prevent her. However, a different opinion could be possible if the documents are perused.

1.You cannot claim for your share since your mother is alive.
2.If you can prove the court that your mother is mentally retarded person, you can prevent her to dispose the property.
3.She can sell the property
