Can shop owner break the wall without owners permission

12-Sep-2023 (In Property Law)
I have a 225 sq feet house on main road in Delhi which has 3 shops and 4 floors above . One of the shop owners has bought house beside that and he wants to break the inner wall but I being the owner has issue because it is a load bearing wall and it was constructed 30 years ago and it already has ceiling marks on walls. I called an architect and he also suggested not to take any risk, So can the shop owner break the wall without my permission and what legal action can be taken if he does so

I have perused the contents of your query and would advise you to issue a legal notice followed by a suit for injunction thereby restraining the shop owner from breaking the wall which is not safe as pet the expert architects opinion.

No, the shop owner or any person for that matter cannot break any wall or make any structural change to the building without the permission of the owner. The owner has several remedies from injunction to claiming damage and eviction . However, Kindly provide me further details so as to enable me to advise you better
