Can property be sold if it is in the name of deceased grandfather

Hi Team, In am inquiring regarding a property in Mumbai which is in my grandfathers name (dead 40 years back). This property is in pagdi system. Now my mother wishes to transfer and sell the property. Looking for advise in this matter. Thanks and regards.

If this property is located in Mumbai 1stly you have to apply for succession certificate if your grandfather died intesated ,so for this kindly apprch any Bombay highcourt lawyer he will give you good suggestion

Whether you are still in possession of that property? If yes, then write a letter to the landlord and get the name in the property transferred to your father or mother's name and then you can sell the property.

As per your query,

Since the property is in the name of your Grandfather and the same in in Pagdi system, you need to obtain the consent of the Owner of the property and only after his consent you can transfer the same. Need to execute a tri-party agreement for the same.
