Can person demand money back due to delay in property

Booked flat on 2008 and still not ready. Can I demand my money back from the builder on account of undue dalay?
Of c ourse you can file a case in court....now a days permanent lok adalat delievers a speedy trail...so you can always get your money recovered but with no penalty....
Secondly if you want penalty amount also you can file a complaint in consumer court but that will take a long time....
