Can partner sell his share , stay by court. Court case against me.

I have 50% share in a flat but a court case (civil) is going on against me regarding my bank a/c in which court has put a stay on the property. Now my partner wants to sell his share . Can he sell it? Thank you .

hello client as i can see your issue is really harming you . as you said now your partner having a view yo sell his share in this regards what you are willling if you want stay can be vacated also and your lartner can also be stoppes from selling his share aswell.

No according to the court you have to maintain the status quo i.e. you cannot change the status of the property till the pendency of the ongoing suit and no third party rights can be formed in the said property until unless the stay is vacated by the court itself.
