Can panchnama be used as a legal document
24-Apr-2023 (In Property Law)
My father and uncle had a land partition after the grandfather death. These all partition are done under the local PANCHAYAT and they made a Panchnama with both party consent. In this panchnama everythings mention regarding the ownership of house(My father & uncle ). But unfotunetly my uncle is not vacating the room which belongs to my father side as per mention in Panchnama. What ever time given to both party to vacat the house. My father has vacant the room long back which belongs to my uncle side but my uncle is not vacating the room. As per the Panchayat's panchnama both party have to abide the decision. But now whenever we say please vacat the room than my uncle used to start quarreling . Is it, this Panchnama is valid for further legal issues? Please suggest me what to do now? Thank you
Panchnama has as legal value as a court decree. Your father can approach local police for vacating the house , on the basis on Panchnama. If police is of no help, you can file title suit on the basis of Panchnama

Yes , it can be. Though it can not be treated as legal document but you can use and produce the same as an evidence in/before court of law. It is better to contact a good lawyer, apprise him about all the facts and documents and act according to his advice.
