Can out of court settlement prove beneficial for me

Dear Sir I am an Hindu by religion This is regarding Specific Performance Suit iniciated by the plaintiff PW1 against me in 2012 PW1 to PW4 were examined by our Councel and it was closed in Dec 2017. Now I as DW1 is to be examined by Plaintiff Council Meanwhile Plaintiff has made a compromise offer and withdraw the suit against me in lieu to settle for one part of property and buy the same at present market rate for which I also have agreed to part away with one plot and keep another plot for myself. Sir I need ur kind advice how to proceed further do I have to go by ADR .out- of- court settlement and make an compromise agreement .Our next case hearing is posted after summer holidays in June. We have one months time. Please advice me sir in this matter. Thanks with kind regards

It is the discretion of the Court. Since for settlement of part of the suit schedule property the permission for compromise is required by the Court. If the court permits you can go ahead. First both counsels shall file a joint memo for compromise before the Court.

Basing on the documents which you have for the property the question of compromise to be decided. If you are having categorically winning chances then need not go for compromise if not better to go for it.
