12-Jul-2023 (In Property Law)
I am Hindu, married since 18 years ,there are 3 residential houses in my name which came to me by way of partition deed from my parents , registerd in subregistrar office legally in my name ,all three are ancestral property from my grand father ,I have 1 son minor , does my son or my wife have any legal rights on these property as long as I live ,can they ask for a bit of this property in future ,I am a govt doctor by profession hard working nature but my son aged 14 years is not giving attention to studies and since my wife is not well educated , i fear there will be temptations for them in future to go for this act as there are no proper guiders for them ,as they do not respond to my advices always looking for easy living and solace . Can it be possible ?
As the property is your ancestral, your son will have half share over the property. Because he is a minor, your wife could possibly lay a claim over the property on your son's behalf through a suit for partition in the court of law.
Your wife, however, does not have a right over the property during your lifetime. Because you have inherited the property from your father, your son does have a 1/2 share in the ancestral portions of the properites.

Your wife is having right of residence and right of her maintenance over the ancestral property that is presently in our name, since it is ancestral. Your son has a share equal to you. But your wife cannot demand partition.
