Can my husband claim his grand mother's property

My father in Law just registered property on his name got from the division after death of his mother recently,they divided equally among all children including my father in law ,but my father in law isn't willing to divide equally among all his children,he wanted to give only to daughter is this possible? My husband can claim ?

Yes, your husband can get his ancestors property, that is not earned property from your father in law, so obviously that is an ancestors property , should distribute equally among all of them. Consult and file suit.

sir/ madum, you have not properly stated whether the said property is maternal or paternal side one. how his mother had got acquired, has not been stated. so it is not possible to answer with out scrutiny of the all document.

property which devolves upon a person from his ancestor and not in the restricted sense of the Hindu law which imports the idea of the acquisition of interest on birth by a son jointly with his father. Thus that under the Hindu law property inherited by a person from his maternal grandfather is not ancestral property qua his sons. inheritance of ancestral properties prior to 1956 made such properties HUF properties in the hands of the person who inherits them, but if ancestral properties are inherited by a person after 1956, such inheritance in the latter case is as self- acquired properties unless of course it is shown that HUF existed prior to 1956 and continued thereafter.
Therefore, you need to tell me the source of the property that your father-in-law got registered to his name from his mother, means from whom she got it ?
