Can I stay in my parents house for life?
31-May-2023 (In Property Law)
I stay in my parents flat. It is 50-50 owned by mother and father. We were 2 sons. Elder son stayed in this house from 1984-2005, then left house. I, younger son, have stayed in this house from 1984-2022(present day). In 2021, mother died suddenly. In 2022, brother died suddenly. Father is asking me to get out of his flat. Do I have right to stay with my wife and child in that flat?
As informed you earlier that in your peculiar case after the death of your mother you became 1/6 owner of the house so your co owners of the house ie your father and your brother’s wife and children ofcourse you can live there being owner but they can always tell u to occupy only 1/6 portions and 2ndly u can take your share and leave also Incase the property is sold u will be a party to the deed being 1/6th owner so you can continue living
