Can I claim the money used for construction of Plat on Father's name

We are a Hindu Family, Recently my father expired without writing a will. My mother has already expired in 2015. Now we are two brothers and one sister. My father had purchased a plot in 1973 in government service and retired in 1990. After his retirement, both of the parents thought of constructing a house on the plot. So in 1994, he looked out for a loan from a bank but due to no pension or earnings banks rejected it. Being in a job and my younger brother was studying. So I became a co-borrower for the construction of the ground floor and repaid the load up to 2004. In between, I got married, my family expanded, in 2004 another loan in my name and father's name was taken to construct the first and second floor. I repaid the load partly through the rent of the second floor and partly by my earnings till 2014. A renovation loan was also used for renovating the house. As I have mentioned unavailability of fathers will can I claim the money I have used to help my father construct floors?

In such case you need to share a few further details like whether your younger brother is self dependant or not and whether ther load taken by you around in the year 2004 was specifically for construction or not.

Hello if father died inestate i.e without a WILL and mother already died in 2015. therefore you and your brother and sister becomes the legal heir having equal right in the movable and immovable properties. You can enter into a family settlement with brother and sister and amicably resolve claiming the amount spent on the construction of house and repayment of loan or you may increase your share in property amicably. Incase dispute is not resolved amicably you can avail Civil remedies available in law consulting legal counsel.
