Can i buy a property behalf of a person's mother WILL

Can i buy a home on basis of a registered will which was created in 1988. It mentions two brothers It clearly shows 1 brother will be the Absolut owner after her mother death Can i buy his home

We would like to legally peruse the contents of the Will and would need certain clarifications before giving our considered opinion on the same. Further would like to know as to weather the testator is alive or not. You may consult

No you can’t buy property only basis of WILL, the said brother has to first get the property mutated under his name at sub-registrar office only then you must buy the property! Bcoz it has been noticed that sub-registrar might ask for probate on will ! Plz n in touch

Firstly it has to be seen where the will was executed and registered as in some states the probate of will is not compulsory. Even otherwise practically saying probate of will from court shall be taken for getting the authenticity of will. One should proceed thereafter. Even a new buyer is more cautious which makes selling the property difficult without probate.
