Can grandson claim share in grandfather's property?

Mera dadaji ka nam property hai parantu mere Papa aur dadaji, dadiji ka death ho chuke hai .Mera Papa aur 8 unke bahan the par ab mere 5 bhua log jinda hai unko pahle seemere dada just property de chuke hai unke shadi ke time and much mere papa ka nam ka property nahi mila uskeliye kya karna padega mujhe me abhi 24 sal ka ho gaya hun.please .Ujhe advice do

Your family property will be divided into 9 equal ie all brother and sister of your grandfather it doesn't matter weather your bua are married or not after dividing your grandfather property in all children's you will get the property which will comes in your father part as you told father is not alive then it will be on name of your mother then you can get the share.in short you will get share in your father's part which he will get from his father after dividing in equal parts to all children's

As per the amended Hindu succession act there are the rights of the female members also in the ancestral property but in your case if some property has been given to the female members then please provide the detailed documents pertaining to the property given and if your grand father is alive then ask him to prepare a Will with a proper divindent of shares in the property including the property given earlier and the residual property or else you need to file a partition suit with respect to the remaining ancestral property before the civil court

आपको उसके लिए न्यायलय में अपने पिता जी के विरुद्ध दावा पेश करना होगा बटवारे के लिए और अपने हिस्से की मांग करनी होगी तथा न्यायालय में साबित करना होगा की जो संपत्ति है वह पैतृक संपत्ति है उसमें मेरा समान प्रकार का हक है। जब आप इस प्रकार कस दावा पेश करेंगे और न्यायालय में साबित कर देंगे कि जो विवादित संपत्ति है वह पैतृक संपत्ति है तब न्यायालय आपकी संपत्ति का बंटवारा कर देगी और आपको आपका हिस्सा प्रदान कर देगी।
