Can father in law disown daughter in law from ancestral house
10-Jun-2023 (In Property Law)
My husband filed divorce based on false allegation..I will not give divorce as I am deeply attached with him, since we were live in rented house and now he moved somewhere else n not giving me his address, I started living at my matrimonial house...my in-laws r forcing me to leave the house but I don't have any accommodation, it was ancestral house ( my husband's grandparents house).. my question is if I am now already living here, can I legally get a court order to fix my stay.. so that if I go somewhere for any work they couldn't resist me to enter again..also they locked my personal room n I am living in other room, can I unlock my room by myself
You must appear in the divorce case which your husband has filed, further file petition under domestic violance act, which includes shelter, food, maintenance and free from mental agony from your in laws and your husband.
Yes you can unlock your room and law does not stop you from using the matrimonial house. You can approach civil court and seek stay from court and you can also file case as provided under Provisions of Prevention of women from Domestic violence Act. Wherein you can get the right to stay in the house and also you can claim other rights such as maintenance and retrain orders etc. So you are advised to approach the court and get orders in your favour.
File domestic violence case and moved application for interim relief of right of residence.court may pass residence orders,so need not to worry at all.File domestic violence case in the court as soon as possible.
If you are a legaly wedded wife of your husband then you can ask for maintenance from your father- in- law through court under maintenance act, also can demand accommodation to stay but subject to matter of brief discussion.
