Can father give half share of property to son, right of survivorship

My father own a house in Kolkata as a sole owner, can he gift 50% share of the property as a joint ownership with right of survivorship to me. We are Hindu by religion.

Yes, he can gift his half share in the property to you by executing and registering a Deed of Gift in your favour. You will become the owner of 50% share instantly.
Subsequently, your father can also execute a WILL in respect of the remaining half. Settlement Deed can also be a option.

Your father is the sole owner of a particular property I.e. 100%. He have every right to deal with the property either in full or in part as per his own wish and wisdom.
Hence he can transfer 50% undivided share to you.

Dear client,
As per the details given by you I would like to suggest that if your father has self acquired property then he can obviously gift his any share in the property but if he has inherited the said property then the case would be different. And if you are the only son of your father without any legal heirs then only you can get the whole share of your father's property .
