Can a mother who has acquired house property from her husband on his death, transfer it to anyone in her will ? Or will it be counted as ancestral property which will have to be divided amongst children?

The person when he or she is alive can transfer his or her property to anyone. Further, to prove ancestral property you should be able to prove that from generation to generation this property is being transferred and the property is being revolved in and around your property. I would further love to help you if I am able to review your documents.

Hi
Whether property is ancestral or separate , has to be decided upon characater of property. So is husband was separate owner of property or in other words does this property was self acquired property of husabnd. If answer is yes, then mother can transfer her undivided share to any one as per her choice, but the purchaser will have to file suit for partition for possession. In law any Co owner can transfer undivided share as per desire.
