Can a son ask for the property rights in his fathers property

14-Jun-2023 (In Property Law)
Son is asking his father to transfer fathers property on his name.Sons mother expired at the time of his birth then there paternal aunt uncle took care of him as his father was not married again.later his father was married and then his step mom asked for his and his elder sisters custody so his aunt did not give her son, she handed over his sister to his stepmom. He is now asking for some amount as he wants to take his own flat. Even if he is been brought up by his uncle and aunt he still uses his fathers name with his name. Can the son ask for property rights of his fathers property?

Yes son can ask for his right in the property of his father. as he has complete right in his paternal property irrespective of his father's second Marriage...and even though he has brought up by his aunt he can claim his share.

As per your query,

The son cannot ask his share or rights in the self acquired property of his father. The father has right to dispose of his property as per his will. However if the property is a ancestral property the son gets his right by birth and he can ask for his share in the property.
