Can a son and wife raise objection to sale of property

15-Jul-2023 (In Property Law)
My father is a businessman and proprietor of a factory. He is planning to sell the factory without taking me and my mother in confidence and we had been kept in dark of this plan. His reasons are that he is unable to run the business and want to sell it as factory has been in shut down condition without any activity. Me and my mother is against selling of the factory as it was the only source of income and I am currently jobless and want to keep the business as an occupation open. Also I am willing to take the initiative to run the factory but he is not allowing me to do so.Also the price at which he is selling is low when compared to market value. My question is can I raise objection against this property sell?( My name is not in the nominee of any property) Also the land of the factory has been under lease from the govt. Can a property under such lease be allowed to sell?

Venerated Questioner,
As per your query You want to know that whether any person have right to sell the lease property of Government land or not..
Ergo, I would to inform you that your father have no right to sell the lease property to any other person vis- a viz he have no right to sub let the lease to other person without prior approval of Government Department who executed the Lease agreement. you have right to challenge the sell and inform the department regarding this incident. You can also take over the property in your name with the permission of the aforesaid Government Department who released the lease to your father. If your father developed the property with the help of ancestral earning then you have also right in that property and on the basis of legal heir you can hold company post... If it is an ancestral propertly, you can raise and objection. If it is the self acquired property of your father, legally you cannot. However, there are various ways by which you can delay sale. Technicall, he will only be selling the movables and steps for transfer of the lease would be taken.
