Can a property be claimed son which is on mother's name?

29-Jun-2023 (In Property Law)
My father purchased a land in my mother's name. My father constructed one portion of the house on it. After my father's death, I extended our house with my personal loan. My mother is a home maker. Now my mother wants to sell this property or give it to my younger brother who has no contribution in it. Can I claim on this property in legal way?

Yes, u can claim legally your right by proving all about the investment you done in said property. All payments u made towards the instalments and or repayment must be on record. In that duration of extention u taken that loan and invested therein.

Dear client,
As per the details provided by you I would suggest that if the property stands in your mothers name she has every right to dispose the same as per her wish but as you said that the property was purchased by your father in your mother's name as your mother being a homemaker at best you can claim the property under the provisions of Benami transaction Act.

You are in possession of the land. I will go one step ahead here,in fact your whole family is staying there. Sir your mom is old take care of her and make sure that no quarrel takes place in your house. Legally your position is weak, I assume even you know that but let say from a local court I get you an order of status quo by filing a TITTLE SUIT. and say you live in the property for decades, how does that sound.
