10-Jul-2023 (In Property Law)
I am Hindu married woman aged 32 years. My parents since childhood has not done their duty towards me. I had to look after myself. Can I claim property rights both movable and immovables. What is process. I have one brother also. My father is a retired school teacher. What can i do ?
Till your father is alive you have no right to his self acquired property. If he goes for will U/S 2(h) of the Indian Succession Act 1925, you can not compel him to include/preclude you in his testament. After the death of your father, if both his movable and /or immovable properties are left intestated, you will be one of the Coparcener of your father's such properties. For further information contact lawRato.

Dear client,
As per the details provided by you I would suggest that if the property belongs to your father or if he is the owner and still alive you cannot claim anything and if during his life time if he transfers the property to anyone then you have nothing to say... Because the Hindu succession Act has many changes after 2005.Please provide more details for proper answers..

Hi. When you got married? Which year your marriage was solemnised? Please mention it. As per the amendment made in 2005 of Hindu Law if a woman married before 2005 and her father died before 2005 she dosen't have any right over parents property. But here your father is alive and you've one brother. But you should mention your date of you marriage.

Mam normally an unmarried girl can claim maintenance from her parents and you are married so maintenance is out of question. Now coming back to property, The property he made out of his money which he earned while at service, he can while he is alive can gift it to anyone and can give to any one by way of will. If he dies interstate you can claim half of the property as I assume your mother is no more. And if the property is ancestral than you can claim half of it irrespective of any hindrance.
