Buying a flat on Gaothan land requires caution. While the builder having a MAHARERA registration and property card is a positive sign, the absence of a 7/12 extract raises red flags about land ownership and title clarity. Key considerations: Gaothan Land Nature: Gaothan lands are village settlement lands, and many are not converted for non-agricultural (NA) residential use. Ensure the land is NA and permitted for building construction. 7/12 Extract: This is a vital revenue document showing ownership, tenancy, and encumbrances. Its absence could indicate unresolved title issues or ongoing litigation. Legal Due Diligence: Before proceeding, engage a property lawyer to: Verify title through search report & title certificate. Check for NA Order, Building Plan approval, Commencement Certificate, and Occupancy Certificate (if ready). Confirm that the land is free from acquisition, litigation, or tribal restrictions. Builder Credibility: Check builder’s past project history and compliance.

Dear client based on your query, acquisition of property lacking foundational land records may warrant enhanced scrutiny, even if regulatory registrations appear in place, for relevance we can help you regard the process and in legal ways for which you can connect with us.

It will be okay to purchase a Property in a Gaothan Urban area (which is a residential area within a village or town) even if it doesn't have a 7/12 extract, but, has a property card and is RERA-registered. The 7/12 extract is primarily for agricultural land, while the property card is for urban properties, whether falling under urban areas of Gaonthan or Proper Cities!
