Building height is over 15 meter

I bought registered flat on 3rd floor . June 2018. Building is made by Builder it has 20 Flats. 16 Flats are registered and 4 Flats made on TOP FLOOR are not registered. 14 electricity meter are already in the building before i bought the flat but when i applied for electricity connection , BSES Rajdhani said because the building height is over 15 meter so they need fire NOC. And its impossible to get fire NOC in this Builder's made Building. I asked Builder to demolish the top floor, so that others can get Electricity connection but Builder refused and said he made money with Illegal top floor, so he will not demolish. Do whatever you want to do. I have already raised concern in Griveance in SDMC , MCD to demolish the illegal top floor but no action. None of my tweets are reverted. 1 year has passed . Can you advise what action can i take.

Query perused. I would advise you to file a complaint under section 415 IPC for cheating. The builder dishonestly induces you to purchase the property knowing fully that it is not liveable. Meter can't be installed. For further consultancy and legal services you may contact us .

please file an FIR before the local police station. additionally and more importantly you can file a complaint before the consumer court asking for compensation. just to show the Builder that you are serious about initiating legal proceedings please send the legal notice which is properly drafted .

Respected sir you stated that you brought a flat on fourth floor from the builder and builder made a anothrised fifth floor now builder are not demolished the said fifth floor . now you can file a case the bulider regarding the illegal construction before the court

hello client as you have said the issue you are facing in ur building which you have faced . as the present sinario is going on tht builders are doing fraud by the flat buyers innthese conditions its very difficult for a buyer to fight with the builder . in these conditions you have already twested the issue very much in wrong direction and through authorities you have demolished only the roof of the top floor . in this matter you can only get relief from high court tht is only the way to skip these peoblems.

u can file a writ in hc for directions to all concerned authorities to demolish the illegal floor and to direct the authorities to install electricity meters in the building thereafter. the writ is an immediate relief otherwise u can file suit for injunction against the authorities in district courts.

If the total height of the building is more than 15/17.5 meters but the dwelling unit is within that height, you needn’t need a fire clearance see para4(1)(i) DERC Guidelines
