Builder not returning booking amount paid

I had booked a flat with the Lodha group by paying a booking amount of Rs.99,000. There was no agreement signed. After a few days, however due to financial problems, I was not able to gather the amount for 1st installment that was around 4 Lakhs. I spoke to the sales people and they say that i will not get any refund since there is no such law that compels them to return the booking amount. Can they do that? I mean they will surely sell that flat to some other customer and also keep my hard earned money of almost 1 lakh ? What steps can i take?

file civil suit for recovering money secondly first shoot notice to builder and then file civil suit
if the project is registered with RERA file petition under RERA no builder can retain your money if you dont wish to buy the flat

This is my response to you:
1. You can complain to MAHA-RERA;
2. Claim full refund of the token amount;
3. Also seek compensation from them for the mental and physical harassment;
4. They have violated section 12 and 13 of the Act;
5. Consult a local lawyer and obtain better legal opinion.

Do you have any booking confirmation, payment receipt or allotment letter, then you can file compliant under RERA and seek refund of the booking amount.

Full amount will not be returned though, 10% deduction is applicable.
