builder fraud 2 different sale deeds were made for one property

My father made a sale deed for purchasing an ready to move flat on 2006 and he took a loan from a bank and after 6 months he requested the builder to register the property in his name but he refused at that time and told him to wait for sometime after 1 year he committed suicide (reason unknown) but my father continued paying his EMI after 4 years some people came to our flat and told us that another sale deed was made for that flat and the party sanctioned a loan from another bank.Now before 1 year we came to know that our flats padlock has been broken and some people captured our flat my father also contacted the bank regarding this but they told us that they dont know anything and they want their last EMI back that is around 50k which were left intentionally by my father .
It is necessary to know that as there was bank loan on the part of your father, then whether your father has registered Sale Agreement in his favour or not and whether possession was given to your father. As you have specified that there is a Sale Deed of another party in respect of the same flat, then whether that has been registered or not. It seems that the other party that the other party has taken possession of that Flat be it legally or illegally. since you have got the sale deed registered and have also almost paid the EMI for the flat then you got to know that the builder sold this flat to second party too... this he deed intentionally so he finally commited fraud with you.. which amount should be paid to you or you should get the glat back you have to file case....
