Builder EMI & Subvention related query

I have taken a property with a subvention for 2 years Further the builder also has given a letter stating post subvention if soft possession is not given However even today the building is half done and the emi has started and builder is avoiding to pay stating COVID as a reason which has led to his poor finances Please suggest what can I do in such a scenario

This is my response to you: 1. Is the property rera registered? 2. If yes then a complaint can be filed there; 3. The information is incomplete, provide more details of your case; 4. Consult a local lawyer and take steps.

If each and everything is in writing then in such situation you have to issue legal notice to builder and keep your side. If he is not taking any cognizance even after receiving the legal notice you have to file complaint before consumer forum in regard to deficiency of service.

Dear Querist, first question is whether you want to be in the project?? What were the terms of tripartite agreement? You can file a complaint in Rera on the grounds that builder has failed to fullfill the contents of advertisement material. And you should get and order for payment of pre-Emi by developer or exit from the project. Regards, Rakesh V. Misar
