02-Jan-2023 (In Property Law)
We are 3 brother. Father has a self made shop and a house. The middle brother gives pain to father but the mother favors him. Father helped him to get a house which he got transferred on his wife's name and now father wants to remove from his house? How can we legally do it?

How do you describe 'Self Made'. Is it an Ancestral Property? or a Property purchased by the Father Entirely at his own Cost?

In case of an Ancestral Property the Family Member's Residence is a matter of Right usually, but,

If the property is entirely self acquired/purchased by Father alone then the situation can be different. There are legal remedies which could be sought for.

Please provide sufficient details.

You may issue alegal notice and thereby also issue a public notice in local news paper. If the property is self earnings of your father he may declare it by will deeds, or can bequeath his property by making proper deed and exclude the son from the same.
