Brother not ready to make partition deed for ancestral property

The property is in my mothe name after death of my father. Now my brother is denying for partition deed. Moreover he constructed a building in that property without transferring yo his name

if your father had not made a will then the property should be partitioned on the demand of any one of the heirs. you obtain certified copies of title documents and Knatha extract and file for partition. No need to issue notice.

You file a suit for partition and injunction. Contact an advocate who is practicing at Civil matters and summarise your facts to him and you will get the solution. Ensure that the property which you want to claim now is the ancestral property and not the self acquired property of your brother.
