No your Brother-in-law can not include your share of property in family partition as only joint property of your family will be included in the family partition. As you are the sole owner of the property acquired by you from your own earned money.

It appears that during partition, the above stated fact as mentioned by you pertaining to inclusion of your self acquired property in the partition suit thereby causing the same to be alienated from you, has not been brought to your notice. Presuming that a decree of partition might have been passed, you may file a suit now for declaration of right title interest on your self acquired property. However, any appropriate advice is dependent on the perusal of the relevant documents in this matter.

Whether that family partition was done mutualy or through Court ? If through Court, then you should have filed your objection then and there.
If it is done mutually and you have signed the same, then you have given your consent for the same.

Unless I discuss it with you, I will not be in a position to clarify things in deatils.
