Broker asking for more brokerage what can be done

We have rented a flat on 11 October 2016 and made a rent agreement for 2yrs. On that time we have paid our security deposit, and brokerage which was equale to one month rent. Now its a month of January of 2017 and broker is asking for brokerage saying that it is a new year so you have to pay brokerage of this year in January it self. Its not even a year completed that we have paid brokerage. Can you help me what should I do legally?

If broker is registered then only he can get the commission other wise no. Also it is given for one time and not for every half year. You can give him legal notice for giving the tort. Thanks & regards

Hi,
Who is to be paid the Brokerage? If it is paid to the broker whom you had contacted to arrange for the flat what was your commitment? Normally Brokerage is paid for once before occupieing the flat. Brokerage is oblished only it is the practice to help the tenant or land lord as the case may be .No person can claim legally for brokerage every year.You need not pay the brokerage.

Brokerage is not admitted contract unless both parties admit it in a legal way.
In your case liability to pay extra brokerage is not mandatory on you if no such previous contract is there in between you and broker.

if you have not made any agreement of brokerage with broker, then you are at liberty to ignore the broker and his demands as no legal action lies against you.
In the absence of written agreement of brokerage, broker can not recover any amount from you. However you have already paid the brokerage equal to one months rent. That has put an end to your moral obligation towards the broker.
It seems that you have unmindfully agreed to pay brokerage for the every year of leave & licence. Such agreement is made out of duress. You need not perform it or you may refuse to perform it.
In the absence of proof, broker can never succeed in his action if he ever takes up any.
The police has no role here to play so you need not worry about any police action at the instance of broker.

Is he registered agent?
Even if he is registered or not, no need to pay him again. Legally its not compulsory.
Even ethically too. As 1 year have not completed as per your Agreement.
Register a complaint to police about this. Try to collect proof that he is asking brokrage, coz there are chances that he will refuse before police that he is asking brokrage and you are allegating on him....
