Booking amount forfeit issue with the builder

I have paid paid booking amount with builder to buy a flat. Due to some problems I was unable to continue and requested for money back. I am ok with deduction of 10-20% of amount. But they are not agree on that finally they offered 50% deduction. I have requested conciliation through MahaRera but they have not answered on it. Should I file the complaint with MahaRera? And what tha chances of recovery?

Please file your complaint at MahRERA . You would definitely get justice provided circumstances / background behind non-payment should be exceptional. If not satisfied then you file appeal in MahRERA Tribunal

Sirji, Actually once u book flat u have to take it. But in exceptional circumtances u r not willing to bye it then the builder have return back ur booking amount but when he get he new buyer of ur flat which no objection obtained by u. U can make a complaint ti Rera may be u get ur book amount. In my opinion

This is my response to you: 1. File a proper complaint to MAHA-RERA; 2. You should claim whole 90% from them; 3. Also ask for compensation for the mental and monetary loss suffered by you; 4. Say that the builder is violating section 12 and 13 of the Act; 5. Consult a local lawyer and file the complaint and argue the same.
