BMC demolished without any notice

Our matter was in city civil court and were having date of 25 February but BMC demolished our house and now they are doing compound please
Well, you can seek monetary compensation from BMC by filing a case against them in Court. However, before filing a Civil Suit against them, you need to serve them with a Legal Notice of 90 Days in advance.

If your house was demolished by BMC despite the matter being sub judice in the City Civil Court, it may amount to contempt of court and violation of natural justice. You can file an urgent application before the same court under Order 39 Rule 1 & 2 CPC for an injunction and seek a stay on further action. Additionally, you can file a writ petition under Article 226 of the Constitution in the Bombay High Court for relief and compensation.
