Asking tenant to vacate but refusing

Hi Sir,
we have been asking our tenant to vacate for our personal use since Apr. We agreed with all his excuses to stay. Finally, he is still asking for time to vacate. This is his reply email. When the tenant stays, who is a responsibility to pay maintenance charge if management decided to increase?. His lease ended on Apr. We did not sign any agreement sofar.
""This is regarding repair and maintenance of the Apartment where I am residing at the premises owned by you for rent. The office bearers asking ₹5000.00 per month for some period. Last Saturday only they told to my wife. Daily they are insisting and I believe that they have sent mail to you also.
Kindly suggest.
Regarding vacating the premises I am in receipt of your mail and letter, I cannot proceed with that due to some sentimental reasons though I am an atheist. My family members insisting that we can vacate only after third month memorial of my late father, ie., during Tamil month of aippasi. Kindly bear with me."

if the tenant is refusing to vacate and after the agreement period that and it should work it if there is no any agreement then then then you should give a legal notice giving a reasonable time to make it even after that period the current is not forgetting you should file election petition before the rent control code and for the period of overstay it is a criminal act and the court will give compensation of two times the rent to you
