Ancestral property sold fraudulently. can we claim our share?
01-Dec-2023 (In Property Law)
I have an ancestral land which has been fraudulently sold twice in the last 10 years. There is no will and 2 persons who have been sold the property are also claiming the property now.
Yes you can claim for that. Ancestral property cant be sold without the consent of all share holder. Every one can sold only his/her share. You have full right on the ancestral property. However you have to prove that you were not aware about that thing because it has time limit according to limitation act.
Yes offcourse it makes your right and you can also claim under section 420 of IPC Act.
But please let me know wheather do you have any proof of fraudulant?
Do you know such peraon?
Is there any record of ancestrol property ?
Thanks and Regards

You must file a police complaint that fraud has been committed in respect of property inherited by you followed by a suit in a Civil Court of competent jurisdiction for declaration as well as cancellation of the documents fraudulently executed.
You will have to array those persons who have sold as well as purchased the property as Defendants.
