Ancestral property all legal heirs want to sell except one what to do

29-Mar-2023 (In Property Law)
We are Hindu family. My grand mother and grand father are dead. My grandpa left a house and factory plot as property. He left behind 4 sons and 3 daughters. My aunts do not want any property and they are willing to sign on that. The youngest uncle has the property documents and the Will. He is not ready to sell the property as he stays there. My dad and other uncle wants to sell it as we are now settled in different city. Even after many years of trying to make him understand, he is not readready to sell giving one or the other reason. What can be done from our end to settle this?

You reserve a right to file a partition suit in the jurisdictional civil court by which you will get your share in the property, after that you can transfer the property except your younger uncle's share in the property in your favor by taking their consent and obtaining their signatures on the relinquishment deed in your favor. Also, you can ask your uncle to provide the amount equivalent to the market value of the share of your father and your aunts and you.
