Ancestor property right for grandson

03-May-2023 (In Property Law)
My great grand father divided his property among his 4 sons. One piece of land and house came as part of the division to my grandfather. These two properties were later inherited by my father (my father is the only child of my grandfather) after my grandfather's demise. My father (i am the only child of my father) sold the land without my mother's/mine permission to a third party when i was a minor. Considering my father's careless decision she filed a case on my behalf (as i was minor then) against my father and the buyer to give my ancestral property rights to me. Court has passed an order of no further sale recently. I would like to know if I truly have the ancestral rights on both (land & house) the properties? What are the chances of getting any share on land which is already sold to third party? (I am from Hindu Religion)

dear friend , yes in that case you see Rights to ancestral property devolves by the rule of survivorship and a child would have a right to enforce partition against his father.
2. YOU CAN FILE A CIVIL LAW SUIT OF INJUNCTION AND CANCELLATION OF A SALE DEED DECLARING THE SAME VOID AND UNENFORCEABLE WITH RESPECT TO YOUR SHARE IN THE PROPERTY IN QUESTION.

good luck and contact for details

In encestral property every surviving heir has equal share. So your father has wrongly sold your share. In civil suit which you have filed claim your share and to that extend pray for cancellation of the sale deed executed by your father
