If there is any dispute or problem moving to NCLT for recovery proceedings. Whereas you can certainly apply for the recovery of the dues through civil proceedings. There is somehow a cloud over the insolvency proceedings post lockdown due tot he latest amendment. Whereas in a pending matter before IBC it is to be seen what kind of order has been passed and if required it can be challenged in NCLAT.

If there is a stay order against CIRP, then firstly, it needs to be ascertained whether you have a right to recovery under the IBC or not. For that, all facts would be required to be examined by an experienced IBC lawyer to ensure that a comprehensive answer to your query can be given. You should take a legal opinion on this first.
