Land distribution as per Muslim Shariah
19-Nov-2025 (In Muslim Law Law)
My deceased mother-in-law has left behind a residential land plot (Maharashtra). She has 3 sons and 2 daughters as her heirs,my father in law is not alive.
If my husband registers her daughters (ie my sistr-in-laws) also in mutation process (ferfaar) as heirs.
Want to understand how can we later divide the property as per Muslim Shariah law? Wont they claim equal distribution as against the 2/3 for sons?
Is there any other way the distribution needs to be handled to make it as per Muslim Shariah?
Notwithstanding her marital status, a daughter remains a legal heir of her deceased mother under Muslim personal law. Consequently, the son of the deceased mother, including the husband in question, cannot claim the daughter’s share. The estate of the deceased shall be distributed among her children in accordance with the prescribed Shariah shares, whereby each son is entitled to twice the share of each daughter.
