Is divorce certificate / decree necessary if Talaq has been given?

1) If husband has given Talaq to wife due to adultery Is it necessary for muslim male to get a divorce certificate or divorce decree from indian court if he has already got talaq certificate from Islamic religious community court?
2) Can father get child custody if wife is given talaq due to adultery, child is 5.5 years old?
1. There is absolutely no necessity to get a decree from court if the talaq papers are signed before a qazi. This talaqnama itself is sufficient to show to the people who would want to know status of earlier marriage.
2. Regarding custody you got to approach court under guardianship Act...
