Under Muslim Law (Sharia), first and utmost right or absolute right to have custody of children stays with the mother (Hizanat) until the child reaches the age of 7 years unless there are some legal exceptions where mother can be barred to have custody of child but in order for you to get the child custody you must produce very strong evidence against your ex-wife. Good luck.

The guardianship of your son will stay with your wife till he attains the age of 7 years after that you can claim your custody rights or if she remarries then you can have the guardianship of your son.
