Wife met with an accident police suggesting out of court settlement

My wife met an accident While Crossing the road. car came in rash and negligent manner and hit her. I complained to police they file 337 IPC Section (that car Driver did not have license but car insured) my wife injuries one leg was fracture i spend 1,80,000 Rs that car person is telling he will give 50,000Rs Only Police person are telling me to compromise if you went to court they will put small penalty and realized them . you will not get this money also Sir Please help me what should i do ?
In case of a motor accident, the victim from the accident gets compensation from the insurance company provided that the motor vehicle has a valid insurance and driver has a valid driver's license. In case the driver does not have a valid driver’s license then the owner of the vehicle and the driver of the vehicle. You can claim for compensation by filing a petition in Motor Accident Claim tribunal. The driver can also be charged under section 337, negligent driving and driving without a license.
