What to do in drunk and drive case

I was drunk & drive my motorcycle. My drink test result was 115.3mg. I was driving my bike in main city.( In crouded area). So it's not possible to drive rush or fast. That day that inspector take action under RTO act 184, 185, 3(1)181, 188. He gave me written FIR copy, which includes the matter under above act I have to go to RTO court on given date. My question is that is court punish me and fine for this acts? What is Fine amount? Give details of these acts means is that all act are valid? Is I accept that in court room or I decline invalid act? Because I got some references like if I disagree with the allegations & talk more or declined invalid allegations like rush driving because that very crouded area. I haven't abused that RTO officer then my fine amount is increasing. I m very simple & common man. I m not in conditions to pay fine. If I will not pay fine then I have to go to police custody? Please answer my questions and give information for further process.

Higher penalties were introduced, including fines from ?2,000 to ?10,000 and imprisonment from 6 months to 4 years. Different penalties are assessed depending on the blood alcohol content at the time of the offence.

Alcohol Level Fines penalties and Jail
150 mg or above per 100 ml blood
First time offence charged Rs.5000 and 2 years imprisonment. Repeated
offence within 3 years Rs.10000 fine plus 4 years jail.
60 to 150 mg per 100 ml blood 1 year imprisonment and/or Rs.4000 fine. Second and repeated offence
attracts 3 years jail and/or Rs.8000 fine.
30 to 60 mg alcohol per 100 ml blood Rs.2000 or/and 6 months jail.
30 mg or lower per 100 ml Offence is not considered at this level of alcohol in blood.

You are saying you were drunk and driving which your were accepting the fact and same charges are put on you by the RTO authority because of which they are going to produce you before the Court, you are also saying that you have no money and simple common man and all, Then y were you drunk that they ? becoz simple man dont drink. You either be simple or drunken person you cant be both.


The Charges are nominal (Fine) just accept your fact and pay the fine .
