what is possibility of insurance case in court

Last week i met with accident, accident was direct hit of my car and bike. In accident bike rider was died due to head injury. I have all documents with full insurance, after accident police filled case on me with ipc304a plus 3 more ipc. Now victim family want to settle dispute by some financial help. My question is if i have settle case than how victim nominee will get 3rd party insurance amount. Is there any possibility only insurance case run in court.
in this case you can have the settlement with the other party. But before doing this you can hire a good lawyer. Because the terms of settlement should be clear and favor your position. The police case if it is non compoundable then can only be quashed from the high court.
